Peak OS User License Agreement

This User License Agreement (the "Agreement") is between Collective Genius, LLC, a Minnesota limited liability company ("we", "us") and you, the person creating a Peak OS account. You get access to Peak OS through an organization that holds a license for you (your "Organization"). By creating an account you accept this Agreement.

1. Your license

We give you a personal, non-exclusive, non-transferable right to use Peak OS (the "Service") for your Organization's work, for as long as your Organization gives you a seat. Your seat is for you alone. Do not share your login.

2. Your account

  • Keep your password and email verification codes private, and tell us or your Organization's admin right away if you think someone else has used your account.
  • You must be at least 18 years old to use the Service.
  • Give accurate information when you sign up.
  • Your Organization's admins can add you to or remove you from teams, change your role, change your login email, and archive your account. If you are archived you lose access, but the work you did stays with your Organization.

3. Acceptable use

You agree not to:

  • break the law or anyone's rights while using the Service;
  • post content that is harassing, discriminatory, threatening or otherwise abusive;
  • access data, teams or organizations you have not been given access to, or try to get around permissions;
  • upload malware, or try to break, probe or overload the Service;
  • copy, resell or reverse engineer the Service except where the law allows it;
  • use automation or API keys in ways your Organization has not approved.

We or your Organization may suspend your access if you break these rules.

4. Your content and your Organization

  • What you put into Peak OS for your Organization (objectives, notes, survey answers, meeting content and so on) belongs to your Organization, and your Organization's admins and teammates may see it according to your role and team.
  • Some features are shared by design, such as team surveys and meeting notes. Write with that in mind.
  • If your Organization works with a Certified Peak OS Coach, the coach may see relevant team data.
  • We handle personal information as described in our Privacy Policy.

5. AI features

  • Peak OS includes AI features, such as the Peak Navigator coach, suggestions and meeting summaries. They send the relevant content to third-party AI providers (currently OpenAI and xAI) to generate a response. [Confirm list.]
  • AI output can be wrong. Check it before you rely on it. It is not legal, financial, HR, medical or other professional advice.
  • Do not put information into AI features that you are not allowed to share, such as other people's sensitive personal data.

6. Meeting recording and consent

  • Meetings in Peak OS may be recorded and transcribed when a facilitator turns recording on. Transcripts and summaries are saved for your Organization.
  • If you start a recording, you must tell everyone present and get any consent the law requires first.
  • By joining a meeting in Peak OS, you consent to it being recorded and transcribed when you have been told recording is on. [Confirm this is the approach you want, and whether a visible in-meeting indicator is required.]

7. Our property

We own the Service, its software, content, templates, the Peak framework materials and trademarks. This Agreement gives you only the right to use them as described here. If you send us feedback, we may use it without obligation.

8. Ending your access

Your access ends when your Organization removes or archives your seat, when your Organization's subscription ends, or if we suspend you for breaking this Agreement. You can ask your Organization's admin to remove you at any time.

9. Disclaimer and limitation of liability

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties and are not liable to you for indirect or consequential damages or lost data. Our total liability to you personally is limited to [$100]. You agree to indemnify and hold harmless Collective Genius, LLC from claims arising from your misuse of the Service or your breach of this Agreement. Your Organization's agreement with us governs everything about fees, service levels and the Organization's data.

10. General

  • Governing law. This Agreement is governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Disputes go exclusively to the state or federal courts located in Minnesota.
  • Changes. We may update this Agreement and will tell you about material changes. If you keep using the Service after they take effect, you accept them.
  • Whole agreement. This Agreement and the Privacy Policy are the whole agreement between you and us about your personal use of the Service.
